By accessing or using Apache Desert’s website, products, or services (collectively, the "Products"), you agree to be bound by this Terms & Conditions ("T&C") and our Privacy Policy. If you do not agree, please refrain from using the Products.

About Apache Desert
Apache Desert is a veteran-owned supplier of premium desiccants, including pharmaceutical-grade silica gel, food-grade desiccants, and industrial desiccants. We offer direct-to-you wholesale pricing, Vendor Managed Inventory (VMI), flexible shipping, and customizable packaging.

Definitions

“Buyer,” “you,” or “your” means any person or entity that accesses or uses the Services.

“Services” includes product catalog, ordering, contracting, invoicing, shipping, and customer support.

“Products” means desiccants, canisters, pouches, and related packaging offered by Apache Desert.

“Contract” means any written agreement, purchase order, or other binding arrangement between Apache Desert and Buyer.
4. Eligibility
You must be at least 18 years old and capable of forming a binding contract. By using the Services, you represent and warrant that you meet these requirements and will comply with all applicable laws and regulations.
5. Ordering and Contracts

Orders: All orders are subject to product availability and acceptance by Apache Desert.

Pricing: Prices are quoted at the time of order and may be subject to change without notice due to market conditions.

Payment Terms: Net terms (e.g., NET 30) may be offered to approved customers. Invoices are due as stated on the invoice.

Minimums and MOQs: Some products may have minimum order quantities or MOQs; these will be disclosed at the time of order.

Lead Times: In-stock items ship within 1–2 business days; customized or back-ordered items may require longer lead times (6–8 weeks for certain customization or non-stock items).
6. Shipping and Delivery

Shipping: We offer nationwide shipping from Illinois, including drop-ship options and full pallet shipments.

Shipping Terms: Free shipping may apply for full truckloads; otherwise, standard shipping rates apply.

Delivery Timeline: Estimated delivery dates are provided at the time of shipment but are not guaranteed. Apache Desert is not liable for delays caused by carriers, force majeure, or events beyond our reasonable control.

Risk of Loss: Risk of loss passes to Buyer upon delivery to the carrier or as otherwise stated in the invoice.
7. Inventory Management and VMI -
Apache Desert offers Vendor Managed Inventory (VMI) and flexible inventory options to ensure availability and reduce customer burden.

Termination of VMI: Either party may terminate VMI arrangements with prior written notice, subject to existing orders and contractual obligations.
8. Product Quality and Certifications -
Our desiccants meet applicable industry standards and certifications (e.g., FDA compliance where indicated). Specific certifications per product will be listed on the product page or accompanying documentation.

Claims and Returns: We stand behind product quality. Claims must be made within a reasonable period after receipt and follow our RMA process. Returns are subject to approval and may incur restocking fees as specified on the RMA.
9. Customization and Branding -
Customization: Custom packaging, branding, canisters, and pouches may be available. Minimums, lead times, and MOQs apply.

Intellectual Property: Apache Desert owns all rights to its branding, logos, and content. You may use our marks only with prior written consent and in compliance with guidelines.
10. Privacy and Data Security -
Our Privacy Policy describes how we collect, use, and protect your information. By using the Services, you consent to our data practices.

You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities under your account.
11. Use Restrictions
You agree not to: -
Use the Services for unlawful purposes or to infringe upon the rights of others.

Interfere with or disrupt the operation of our services or systems.

Harvest or collect data from the Services via malware, bots, or other automated means without our permission.
12. Intellectual Property

15. Limitation of Liability
To the fullest extent permitted by law, Apache Desert shall not be liable for any indirect, incidental, special, exemplary, or punitive damages, including lost profits, arising out of or in connection with the Services.
16. Indemnification
You agree to indemnify, defend, and hold harmless Apache Desert and its officers, directors, employees, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Services or violation of these T&Cs.
17. Termination
We may suspend or terminate your access to the Services for any reason, including violation of these T&Cs, at our sole discretion and with or without notice.
18. Governing Law and Disputes -
These T&Cs are governed by and constructed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles.

Any disputes shall be resolved in the state or federal courts located in Illinois.
19. Changes to the T&Cs
We may update these T&Cs from time to time. The “Last Updated” date will be revised, and continued use of the Services after changes constitutes acceptance of the new terms.
20. Severability
If any provision is found unenforceable, the remaining provisions shall remain in effect.
21. Entire Agreement
These T&Cs constitute the entire agreement between you and Apache Desert regarding the Services and supersede all prior agreements and understandings.
